Terms of Use — AIRes Optimizer
These Terms of Use (“Terms”) govern your access to and use of the AIRes Optimizer service operated by AIResume LTDA (“Company”, “we”, “us”, “our”). By using the Service, you agree to these Terms.
1) The Service
AIRes Optimizer provides resume analysis, optimization, and translation features based on information you provide (including resume content and job descriptions). The Service may use third-party providers (including AI providers) to generate outputs.
2) Eligibility
You must be able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3) Accounts and security
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity under your account.
- You must notify us promptly of any unauthorized use or security breach related to your account.
4) Your content and inputs
The Service allows you to upload and submit content such as resumes/CVs, job descriptions, and other materials (“User Content”). You represent and warrant that:
- You own or have the necessary rights and permissions to submit the User Content.
- Your User Content does not violate applicable laws or third-party rights (including privacy, confidentiality, IP rights).
- You will not submit content that is unlawful, harmful, or intended to misuse the Service.
License to operate the Service
You grant us a limited, non-exclusive, worldwide license to host, store, process, and use your User Content solely to provide, maintain, and improve the Service, including generating outputs you request.
5) AI features
The Service uses AI models to generate analyses, suggestions, optimized resumes, and translations. You understand and agree that:
- AI outputs are generated automatically and may be inaccurate, incomplete, or inappropriate.
- You are responsible for verifying accuracy, avoiding misrepresentation, and ensuring compliance with employer or legal requirements.
- You will not rely on the Service as a substitute for professional advice (legal, HR, or otherwise).
6) Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of applicable laws.
- Attempt to gain unauthorized access to the Service, accounts, or systems.
- Reverse engineer, decompile, or attempt to discover source code or underlying models except where prohibited by law.
- Interfere with or disrupt the Service (e.g., abuse rate limits, introduce malware, scraping that harms availability).
- Upload content you do not have the right to use, or that infringes third-party rights.
- Use the Service to generate content intended to deceive (e.g., falsify credentials, impersonation, fraudulent documentation).
7) Subscriptions, billing, and refunds
If you purchase a paid plan, payments are processed through Stripe. By subscribing, you authorize us (and Stripe) to charge the applicable fees, including recurring fees if your plan is subscription-based.
Trials and plan changes
- Trial availability, duration, and limitations (if any) will be described at checkout or in the Service.
- You can upgrade/downgrade plans as described in the Service. Changes may take effect immediately or at the next billing cycle.
Refunds
Refunds, if any, are handled according to the refund policy shown at checkout or in the Service. Unless required by law, fees are non-refundable.
8) Availability and changes
We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We may also impose limits (e.g., rate limits, feature limits) to protect the Service and users.
9) Termination
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms, created risk, or used the Service in a harmful or unlawful way.
Upon termination, your right to use the Service ends. Data handling after termination is described in our Privacy Policy.
10) Intellectual property
The Service, including its software, design, and branding, is owned by AIResume LTDA and protected by applicable laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Service.
Your content
You retain ownership of your User Content. These Terms do not transfer ownership of your User Content to us.
11) Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or that outputs will result in interviews or job offers.
12) Limitation of liability
To the maximum extent permitted by law, AIResume LTDA will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to us for the Service in the 6 months before the event giving rise to the claim (or, if you have not paid anything, USD 100).
13) Indemnification
You agree to indemnify and hold harmless AIResume LTDA and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service;
- Your User Content;
- Your violation of these Terms or applicable laws;
- Your infringement of any third-party right.
14) Governing law and venue
These Terms are governed by the laws of Brazil. Any disputes arising out of or related to these Terms or the Service will be resolved in the competent courts of Itampema/SC, Brazil, unless applicable law provides otherwise.
15) Changes to these Terms
We may update these Terms from time to time. The updated version will be posted with a new “Last updated” date. If changes are material, we will provide additional notice as required.
